Terms of Use

Last updated September 10, 2026 · Effective for everyone who uses the melynBrain platform and apps

In plain language: you use melynBrain because your Nation or organization gave you access, and its agreement with melyn sets the rules for data, fees, and service. Keep your sign-in private, use only the access your role allows, treat what you see as confidential, and review AI output before relying on it. Your Organization's data stays its own.

These terms govern your use of the melynBrain platform at melyn.ai and melyn's mobile apps (together, the "Services"), provided by melyn ("we", "us"), an Alberta company. By using the Services you agree to these terms. If you do not agree, do not use the Services. Our public website at melyn.ca has its own terms.

1. Who these terms cover

You use melynBrain because a First Nation or Indigenous organization (your "Organization") has an agreement with melyn and has given you access, whether as a staff member, an administrator, or a citizen using the portal your Organization offers. That agreement governs the relationship between melyn and your Organization, including data protection, fees, and service levels. These terms set out your individual responsibilities as a user and apply alongside it. Where the two conflict, the agreement with your Organization prevails for your Organization, and these terms prevail for your personal conduct on the platform.

2. Using melynBrain

melynBrain is a governance and data platform for First Nations governments and Indigenous organizations. Your access is granted, scoped, and revoked by your Organization's administrators. You may use the platform only for your Organization's legitimate business, or, as a citizen, for your own dealings with your Organization, and only within the role and permissions you have been given. Access to another Organization's environment is never permitted.

Information you see in melynBrain about community members, programs, finances, and governance is confidential to your Organization. Treat it as you would any confidential record entrusted to you in your role: do not copy, share, or disclose it outside the purposes your Organization allows.

3. Accounts and security

  • Keep your sign-in credentials private. Do not share your account or let anyone else use it.
  • Use two-factor authentication where your Organization requires it, and keep the device you use to sign in secure.
  • Tell your Organization's administrator and melyn at privacy@melyn.ca immediately if you believe your account or a device has been compromised.
  • You are responsible for activity carried out under your account until you report a compromise.

Your responsibilities at a glance

  • Keep your sign-in credentials private
  • Use only the access your role allows
  • Treat community records as confidential
  • Review AI output before relying on it

4. Acceptable use

You agree not to:

  • Use the Services to break any law, or to infringe anyone's rights, including privacy rights.
  • Upload malicious code, or attempt to bypass access controls, rate limits, or security features.
  • Access, copy, or attempt to access data belonging to another Organization or another user beyond your permissions.
  • Reverse engineer, decompile, or copy the platform, or use automated tools to extract its content, except as the law permits.
  • Use the Services to send unsolicited communications or to harass, threaten, or discriminate against anyone.
  • Enter into the AI features any information you are not permitted to process on the platform.

We may suspend an account that we reasonably believe is being used in breach of these terms, and we will tell the Organization's administrator when we do.

5. Your Organization's data

Data your Organization and its users put into melynBrain, and the records and documents the platform produces from it, belong to your Organization. melyn holds and processes that data only as your Organization's service provider, under its Data Processing Agreement, in line with the OCAP principles of Ownership, Control, Access, and Possession. Each Organization's data is kept in its own separate environment in Canada. melyn does not use it to train artificial intelligence models and does not sell it. Requests to access, correct, export, or delete data are handled by your Organization, and melyn acts on the Organization's instructions.

6. AI features

melynBrain includes AI-assisted features such as drafting, summarizing, matching, and question answering. They are tools to help your work, not a replacement for it. AI output can be incomplete, out of date, or wrong, and it is not legal, financial, or professional advice. You are responsible for reviewing AI output before relying on it or acting on it, and your Organization remains responsible for any decision or document it adopts. AI processing for melynBrain runs in Canadian data centres, and your Organization can turn AI features off for its environment.

7. Intellectual property

The platform, software, designs, documentation, and melyn's names and logos belong to melyn or its licensors. Your Organization's agreement grants it a right to use the platform for the term of that agreement; nothing in these terms transfers ownership of the platform to you or your Organization. Nothing in these terms gives melyn ownership of your Organization's data, its Indigenous knowledge, or its cultural materials. Feedback you give us about the Services may be used to improve them without obligation to you.

8. Third-party services

The Services rely on third-party providers for hosting, notifications, and mapping data, described in our Privacy Policy. Some features open or link to third-party services with their own terms. melyn is not responsible for the content or practices of third parties.

9. Availability and changes

We work to keep the Services available and secure, and we schedule maintenance to limit disruption, but we cannot promise uninterrupted access. We may change or retire features, and we will give Organizations reasonable notice of changes that materially affect their use. Service levels, where agreed, are set out in your Organization's agreement.

10. Disclaimers and limitation of liability

Warranties, remedies, and limits on liability between melyn and your Organization are set out in the Organization's agreement. To the extent permitted by law, melyn is not liable to individual users for indirect or consequential loss, or for loss arising from reliance on AI output that has not been reviewed. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

11. Governing law

These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Where an Organization's agreement provides for a different governing law or for dispute resolution with the Nation's own laws or processes, that agreement prevails for matters between melyn and the Organization.

12. Changes to these terms

We update this page when the terms change and show the date at the top. Material changes are also announced to melynBrain Organizations by email. Continuing to use the Services after a change means you accept the updated terms.
